What is DUI Expungement?
DUI expungement, also known as ‘expunction,’ is a legal procedure which makes certain that your criminal, DUI, or
felony records cannot be seen by anyone outside the courts.
A clean record is an important benefit if you are applying to rent an apartment, to go to a college or other professional school, or when asked by a potential employer on a job application. However, you should disclose this information to your attorney when asked, and certainly by a law enforcement officer or judge. Even if it is sealed, it is best to simply reply to the question with ‘My records are sealed,’ and these officials will guide you as to whether you should reveal the nature of the expungement.
Many government agencies, as well, can view your records through the National Crime Information Center (NCIC). If a person wishes to emigrate to another country, for instance, or apply for public office, these records will not be hidden from sight.
Before you reach the age of 18, unless you were tried as an adult for a crime, your record is sealed because you were a juvenile and the legal system gives you a fresh start as an adult. Otherwise, you would carry your mistakes of childhood with you for the rest of your life.
As an adult, however, you must apply or petition to have your record expunged, and your request will not necessarily be granted.
